News media and the blogosphere are abuzz with discussion of the Comstock case and its implications for future Commerce Clause (and Necessary and Proper Clause) cases. If they really feel that convicted sex offenders are so likely to commit sex crimes after serving a prison term, why didn't they send them to psychiatric help instead of prison in the first place?

since that would be LEGAL except for the small problem that the psychicatric doctors wouldn't touch it. i think the figures show that only aobut 5% of those convicted are REAL PEDOPHILES who have a disagnosable illness. Those are the only ones a real legal doctor would touch.
