On Monday, I blogged about the odd case of a New York town judge ordering a sex offender to serve his sentence in Canada (with return visits to meet with his probation officer). Apparently, Canada isn't all that happy with the idea even though the sex offender prefers to live in Canada with his wife and children. This case illustrates, in a small way, one of the longstanding public policy problems with banishment-type punishments - dumping criminals on other communities usually creates disputes between the dumper- and the dumpee-community. It is essentially the NIMBY principle applied to a sentencing context.
